The gross negligence penalty is equal to 50% of any additional income tax. The CRA tends to view owner-manager draw as shareholder appropriations, rather than loans. The best thing for an owner-manager is to not take money from the company as salary/wages, or dividends. Owner-managers who need to borrow money from the company must document it legally. As such, it is crucial that owner-managers who loan money for their company legally document the loan as well as the repayment. It is also important that the accounting records of the company are consistent with this documentation. This has made it possible to quickly roll out updates and program fixes and requires no user action. A user can access cloud-based apps from any device (i.e. computers, laptops, mobile). Processing accounting records used to be done on paper. All payments and vendor bills are sent electronically today, as well as sales invoices. It is rare that anything is received in paper format. Most documents can be digitized quickly with a scanner, or images captured on mobile devices. What does this mean for an accounting department that is more efficient? The efficiency is found in reducing manual data entry. This in turn decreases human error. The next step is for an application to be read (via OCR), understood, and posted the transactions. Many applications can have parameters set up that allow repeat transactions to automatically be processed. This also includes taking into account sales tax. Are there mistakes? Although no system is perfect, modern systems can provide an analysis of the final result. After data entry has been completed, including reconciliations with banks and credit cards, it's time to pull a detailed profit-and-loss report which shows the expenditure accounts. You can scan the accounts quickly to find anomalies, much quicker than manually entering it. You must also examine where the accounting information is coming from to further improve efficiency. Does every third-party application connect to the end accounting software program? Is that possible? Perhaps you need to reconsider which applications to use in order to make sure all information is connected seamlessly. Many applications today can connect to the full general ledger accounting program. Checks are another area of paper to be aware of. Cheques can also be replaced by electronic file transfers of payments thanks to today's technology. Many companies use the platform of their bank to do this, but it is not connected to their accounting software. Other platforms are cheaper and can be used to connect, which leads to savings of up twofold. What about payroll? Over the years, payroll has been automated and accessed through employee portals. Connecting the payroll to accounting software, if it's a third-party solution, would be the last obstacle. If your current service doesn't support this, it might be time to switch to one that does. You will not be responsible for the withholding if you do not have reasonable grounds to believe the vendor is not Canadian. The standard real estate contract will have a section that allows the seller to declare whether they are a resident or non-resident of Canada. This is for income tax purposes. While the declaration can be useful, it may not provide enough protection to avoid liability. Be aware of other factors that may cause you doubt the veracity or validity of the declaration. Your liability may also be reduced or eliminated if the seller receives a clearance certification from the CRA. Your liability should be limited to the amount shown on the clearance certificates. You are responsible for withholding any difference if the final sale price exceeds that shown on your clearance certificate. The seller's use of your property will affect the amount that you have to withhold. For example, 25% of the purchase cost is required if the seller uses the property for their own residence. 25% is required if they obtain a clearance certificate. 25% is required if the buyer is renting the property. 25% is the amount due to the seller if they use the property for business purposes. The required withholding for a seller who uses the property as a rental property is 25% of its purchase price and 50% of its purchase price. Intangible property **or** service (e.g., a consulting service) that you purchase from outside Canada is not eligible for GST/HST. You can purchase a strong>service or intangible asset from outside Canada and are not subject to GST/HST. However, if you buy software or consulting services for a business that is eligible for full input tax credits, you have a legal obligation. This is **"imported taxable supply"**. This is something that the CRA does not assess consumers for in practice, even though it legally could. If you import taxable supplies for your business, however, you cannot claim input tax credit (e.g. Your sales are exempt and the CRA/RQ could find this out when they audit your business and assess you. 2. GST-registered **agents who sell goods to principals that are not required to collect tax** will be considered to have bought the property from the principal and must collect GST/HST on the entire price charged to customer. Imagine that you have a boat you've used for pleasure and you wish to sell it. The boat is then left with a dealer who sells it to you for a commission. The dealer must collect and remit GST/HST on the entire sale price (not just the commission), even though it would not be required if you were selling the boat yourself. 3. Your business can collect a **deposit** from customers. However, the GST and HST will not apply until you use it as "consideration" to purchase. According to a Tax Court case (Tendances et Concepts Inc. 2011, 2011), what you believe is a deposit may in fact be a payment on an account. In this case, GST or HST apply from the time you collect the deposit. You must also pay the GST or HST for any amount you invoice once you have invoiced it. 4. If you **are selling commercial real property**, the purchaser accounts for GST or HST. They also usually claim an offset tax credit. The purchaser doesn't have to pay any tax. For GST/HST purposes, however, the sale is still considered "taxable". Therefore, if you have a purchase and sale agreement that states GST/HST is included in the sale price, then you will receive only 100/105ths to 100/113ths to 100/115ths depending on the province. Careful of how you word the agreement. 5. Although the **vacant property** is usually exempted when it's sold by an individual there are many exceptions. It will be taxable if the land has been divided into more than two sections. You may have to pay taxes if the land has been rented out. A corporation selling the land is always taxable. A farm with a farmhouse on it is exempt from tax. You should seek professional advice as there are many rules and exceptions. 6. If your business **sues a person for breaching the contract** and the original contract contained GST or HST then any amount you receive in damages or as part of a settlement will be considered GST-/HST-included. You must pay tax out of the total and may be eligible for an input tax credit. You must ensure that you "gross up” the GST and HST when you settle or claim in these cases. However, you might have already paid GST/HST to the client when you invoiced them. This will ensure that your data transmissions remain safe. Secure connections help to reduce the risks. The service informs taxpayers via email of the time or the address of their direct deposit or when details are modified. If a customer authorizes the individual members of your company through the representative's RepID, it is possible that you lose access to the internet for the client in the event that the member leaves the company. **Don't rely too heavily on RAC when you file your client's documents.** The online services of the CRA are an excellent source of information; however, they shouldn't be used to replace properly documented client files. Keep in mind that if you've been removed from the position of authorized representative, you won't be able to access the most important elements of a tax filing, like notices of assessment. So, it is recommended to take a backup of these important elements within your firm's client files.
